1. مقدمة وقبول الشروط

1.1 تُشكّل هذه الشروط اتفاقية ملزمة بينك وبين شركة مواعيدك للخدمات ذ.م.م، سجل تجاري رقم 228056، المسجّلة في دولة قطر ("مواعيدك"، "نحن").

1.2 باستخدامك للتطبيق أو إنشائك حساباً فيه أو إتمامك أي حجز، فإنك تقرّ بأنك قرأت هذه الشروط وفهمتها ووافقت على الالتزام بها. وإذا كنت لا توافق عليها، يتعيّن عليك التوقف عن استخدام التطبيق.

1.3 تُقرأ هذه الشروط جنباً إلى جنب مع سياسة الخصوصية المنشورة في التطبيق، وتُعدّ جزءاً لا يتجزأ من هذه الاتفاقية.

2. التعريفات

• "التطبيق": تطبيق مواعيدك للهواتف الذكية، وموقعه الإلكتروني، وأي واجهة تابعة له.
• "المستخدم" أو "أنت": أي شخص ينشئ حساباً أو يستخدم التطبيق.
• "المستفيد": الشخص الذي يُحجز الموعد لصالحه، سواء كان المستخدم نفسه أو شخصاً آخر يحجز له.
• "العيادة": مقدّم الرعاية الصحية المرخّص في دولة قطر والمدرج في التطبيق، ويشمل العيادات والمراكز الطبية والمستشفيات الخاصة.
• "الحجز": طلب موعد لدى عيادة عبر التطبيق.
• "الخدمة": الخدمة الطبية أو الصحية التي تقدّمها العيادة.
• "خدمة التوجيه الأولي": الخاصية الاختيارية الموضحة في البند (7) من هذه الشروط.

3. طبيعة الخدمة وإخلاء المسؤولية الطبية

هذا البند جوهري، ويُرجى قراءته بعناية.

3.1 مواعيدك منصة تقنية للحجز والتنسيق فقط. نحن لسنا مقدّم رعاية صحية، ولا عيادة، ولا مستشفى، ولا صيدلية، ولا شركة تأمين.

3.2 لا نقدّم، بشكل مباشر أو غير مباشر، أي استشارة طبية أو تشخيص أو علاج أو رأي طبي أو توصية بعلاج أو بطبيب معيّن. وأي محتوى في التطبيق هو لأغراض التنظيم والحجز فقط، ولا يُعتمد عليه كبديل عن استشارة طبية مختصة.

3.3 العلاقة الطبية والتعاقدية الخاصة بتقديم الخدمة تنشأ حصراً بينك وبين العيادة. وتتحمّل العيادة وحدها كامل المسؤولية عن: صحة ودقة التشخيص والعلاج ونتائجه، وكفاءة الطاقم الطبي وسريان تراخيصه، وجودة الخدمة وسلامتها والالتزام بمعايير الرعاية، والأسعار المعلنة ومطابقتها للواقع، والالتزام بقوانين ولوائح وزارة الصحة العامة في دولة قطر.

3.4 لا نتحقق بشكل مستقل من الكفاءة المهنية للأطباء أو من صحة المعلومات المقدّمة من العيادات، ولا نتحمّل أي مسؤولية عن أي ضرر أو خطأ طبي أو مضاعفات أو سوء ممارسة أو نتيجة علاجية.

3.5 إدراج أي عيادة أو طبيب في التطبيق لا يُعدّ توصية أو تزكية أو ضماناً لمستوى الخدمة. وترتيب الظهور في نتائج البحث قد يعتمد على معايير تشغيلية كالمسافة أو التوفر، ولا يعكس تقييماً طبياً.

3.6 في الحالات الطارئة، لا تستخدم التطبيق. اتصل بالرقم 999 أو توجّه فوراً إلى أقرب قسم طوارئ.

4. الأهلية والحساب

4.1 يجب أن يكون عمرك ثماني عشرة سنة فأكثر لإنشاء حساب. ويجوز حجز موعد لقاصر أو لشخص تحت رعايتك شريطة أن تكون وليّه أو وصيّه القانوني أو مفوّضاً منه، وتتحمّل كامل المسؤولية عن صحة البيانات المقدّمة نيابة عنه وعن مشروعية تقديمها.

4.2 يتم التحقق من الحساب عبر رمز يُرسل إلى رقم الهاتف المسجّل. وأنت مسؤول عن الحفاظ على سرية وصولك إلى رقمك وحسابك، وعن كل نشاط يتم من خلاله.

4.3 تلتزم بتقديم بيانات صحيحة وكاملة ومحدثة. ويحق لنا تعليق أو إلغاء أي حساب يتضمّن بيانات كاذبة أو مضلّلة.

4.4 لا يجوز إنشاء حسابات متعددة بقصد إساءة استخدام الخدمة، ولا استخدام حساب شخص آخر دون تفويض.

4.5 يمكنك طلب حذف حسابك في أي وقت عبر التطبيق أو بالتواصل معنا، وفق ما هو موضّح في سياسة الخصوصية.

5. الحجز

5.1 عند إتمام الحجز، يُرسل التطبيق طلبك إلى العيادة. ويُعدّ الموعد مؤكداً فقط عند صدور تأكيد صريح عبر التطبيق أو من العيادة.

5.2 المواعيد المعروضة تعتمد على البيانات التي توفّرها العيادة، ولا نضمن دقتها أو استمرار توفّرها لحظياً.

5.3 إذا حجزت موعداً لمستفيد آخر، فإنك تقرّ بأنك مخوّل بذلك وبمشاركة بياناته اللازمة لتنفيذ الموعد، وتتحمّل المسؤولية الكاملة عن صحة هذا التخويل.

5.4 يحق للعيادة إلغاء الموعد أو تعديله لأسباب تشغيلية أو طارئة. وسنسعى لإبلاغك في أقرب وقت ممكن، إلا أننا لا نتحمّل أي مسؤولية عن إلغاء أو تأجيل صادر عن العيادة، ولا عن أي تكاليف أو خسائر تترتب عليه.

5.5 مدة الانتظار الفعلية داخل العيادة خارجة عن سيطرتنا بالكامل.

5.6 قد يتيح التطبيق الانضمام إلى قائمة انتظار عند امتلاء المواعيد. ولا يضمن الانضمام إليها الحصول على موعد، ويخضع تأكيد أي موعد ناتج عنها لأحكام هذا البند.

6. الأسعار والدفع

6.1 السداد يتم مباشرة لدى العيادة وفق أسعارها وسياساتها المعلنة.

6.2 مواعيدك ليس طرفاً في المعاملة المالية بينك وبين العيادة، ولا يتلقى أي مبالغ بشأنها، ولا يتحمّل أي مسؤولية عنها.

6.3 الأسعار المعروضة في التطبيق، إن وُجدت، تقديرية ومقدَّمة من العيادة، وقد تختلف بحسب حالتك أو الفحوصات أو الإجراءات الإضافية. والسعر النهائي يُحدَّد من العيادة.

6.4 تخضع طلبات الاسترداد، إن وُجدت، لسياسة العيادة وللقوانين المعمول بها في دولة قطر، ولا يتدخّل مواعيدك فيها.

6.5 لا يجمع مواعيدك ولا يخزّن أي بيانات بطاقات بنكية. وقد نتيح مستقبلاً خيارات دفع إضافية عبر مزوّدين مرخّصين من مصرف قطر المركزي، وفي حال إتاحتها، سيتم تحديث هذه الشروط والإفصاح عن أحكامها قبل التفعيل.

7. خدمة التوجيه الأولي للتخصص

7.1 قد يتيح التطبيق خاصية اختيارية تساعدك على تحديد التخصص الطبي الأنسب لاحتياجك، عبر كتابة وصف موجز له، فيقترح التطبيق تخصصات وأطباء متاحين للحجز.

7.2 هذه الخاصية أداة استرشادية للتوجيه فقط، وليست استشارة طبية ولا تشخيصاً ولا بديلاً عن رأي الطبيب المختص. والاقتراحات المقدَّمة مبنية على وصفك وحده وقد لا تكون دقيقة أو مكتملة، والقرار النهائي في اختيار التخصص والطبيب يعود إليك وإلى الطبيب المعالج.

7.3 لا تستخدم هذه الخاصية في الحالات الطارئة. اتصل بالرقم 999 أو توجّه فوراً إلى أقرب قسم طوارئ.

7.4 استخدام الخاصية اختياري بالكامل، ويتطلب موافقتك الصريحة قبل أول استخدام. ولا يؤثر عدم استخدامها على قدرتك على الحجز أو على أي خدمة أخرى في التطبيق.

7.5 يُعالَج النص الذي تكتبه آنياً ولا يُخزَّن، ولا يُرسل معه اسمك أو رقمك أو أي معرّف شخصي، وفق ما هو موضّح تفصيلاً في سياسة الخصوصية. ويُرجى عدم تضمين النص أسماءً أو أرقام هوية أو بيانات تعريفية عنك أو عن غيرك.

7.6 يحق لنا تعديل هذه الخاصية أو تعليقها أو إيقافها في أي وقت دون أن يُعدّ ذلك إخلالاً بهذه الشروط.

8. التقييمات ومحتوى المستخدمين

8.1 قد يتيح التطبيق تقييم العيادات والأطباء وكتابة تعليقات بعد إتمام الموعد. ويُشترط أن يعبّر التقييم عن تجربة حقيقية وشخصية.

8.2 تلتزم في أي محتوى تنشره بعدم تضمين: تفاصيل صحية عنك أو عن غيرك، أو بيانات شخصية لأي طرف ثالث، أو محتوى مسيء أو تشهيري أو كاذب أو مخالف للنظام العام والآداب أو لقوانين دولة قطر.

8.3 بنشرك أي محتوى، تمنحنا ترخيصاً غير حصري لعرضه داخل التطبيق وفي موادنا التعريفية والترويجية، لأغراض تشغيل الخدمة والتعريف بها.

8.4 يحق لنا مراجعة أي محتوى وإخفاؤه أو حذفه دون إشعار إذا خالف هذه الشروط، دون أن يرتب ذلك أي مسؤولية علينا.

9. الإلغاء وعدم الحضور

9.1 يمكنك إلغاء الموعد أو تعديله عبر التطبيق حتى ساعة واحدة قبل الموعد المحدد.

9.2 بعد انقضاء هذه المهلة، يتم الإلغاء عبر التواصل المباشر مع العيادة، وتخضع أي رسوم إلغاء متأخر أو عدم حضور، إن وُجدت، لسياسة العيادة.

9.3 التخلّف المتكرر عن الحضور قد يؤدي إلى تقييد قدرتك على الحجز عبر التطبيق.

10. التزامات المستخدم

تلتزم بما يلي: تقديم بيانات صحيحة ودقيقة، خاصةً بيانات المستفيد من الخدمة، وعدم استخدام التطبيق لأي غرض غير مشروع أو مخالف لقوانين دولة قطر، وعدم محاولة اختراق التطبيق أو أنظمته أو الوصول غير المصرّح به لبيانات مستخدمين آخرين، وعدم استخدام أدوات آلية لاستخراج البيانات أو إنشاء حجوزات وهمية، وعدم إساءة استخدام خدمة التوجيه الأولي أو أي خاصية أخرى بما يخالف الغرض منها.

11. البيانات والخصوصية

11.1 نجمع ونعالج بياناتك الشخصية وفق سياسة الخصوصية المنشورة في التطبيق، والتي تُعدّ جزءاً من هذه الشروط.

11.2 تقرّ بأن إتمام الحجز يستلزم مشاركة بياناتك اللازمة مع العيادة المعنية لتنفيذ الخدمة، وتوافق على ذلك صراحةً.

11.3 تخضع معالجة بياناتك لأحكام قانون حماية خصوصية البيانات الشخصية رقم 13 لسنة 2016 ولوائحه التنفيذية في دولة قطر.

12. الملكية الفكرية

12.1 التطبيق واسم "مواعيدك" وشعاره وتصاميمه ومحتواه وبرمجياته مملوكة لنا أو مرخّصة لنا، ومحمية بموجب القوانين المعمول بها.

12.2 يُمنح لك ترخيص شخصي محدود غير حصري وغير قابل للتحويل لاستخدام التطبيق لأغراضه المقصودة فقط. ولا يجوز نسخ أو تعديل أو توزيع أو إعادة هندسة أي جزء منه.

13. التعديلات على الخدمة

13.1 يحق لنا في أي وقت تعديل التطبيق أو إضافة خصائص أو تعليقها أو إيقافها، كلياً أو جزئياً، لأسباب تشغيلية أو تقنية أو تنظيمية.

13.2 في حال التوقف الدائم عن تقديم الخدمة، سنُخطرك بوقت معقول متى أمكن، وتُطبَّق أحكام سياسة الخصوصية بشأن بياناتك.

14. حدود المسؤولية

14.1 يُقدَّم التطبيق "كما هو" و"حسب توفّره"، دون أي ضمان صريح أو ضمني باستمرارية التشغيل أو الخلو من الأخطاء أو الانقطاع.

14.2 لا نتحمّل المسؤولية عن: أي ضرر ناشئ عن الخدمة الطبية أو جودتها أو نتائجها، أو أي قرار اتخذته استناداً إلى اقتراحات خدمة التوجيه الأولي، أو إلغاء أو تأخير أو تغيير صادر عن العيادة، أو انقطاع الخدمة والأعطال التقنية أو أعطال شبكات الاتصال، أو الأضرار غير المباشرة أو التبعية أو فوات الكسب أو ضياع الفرصة.

14.3 مع مراعاة الأحكام الآمرة في القانون القطري، لا تتجاوز مسؤوليتنا الإجمالية تجاهك عن أي مطالبة أو مجموع مطالبات، أياً كان سببها، مبلغ ألف ريال قطري.

14.4 لا يُقصد بأي مما ورد أعلاه استبعاد أو تقييد أي مسؤولية لا يجوز استبعادها أو تقييدها قانوناً.

15. التعويض

توافق على تعويضنا عن أي خسائر أو مطالبات أو تكاليف معقولة، بما فيها أتعاب التقاضي، تنشأ عن إخلالك الجوهري بهذه الشروط، أو إساءة استخدامك للتطبيق، أو انتهاكك لحقوق أي طرف ثالث، وذلك في حدود ما يقرره القانون.

16. تعديل الشروط

16.1 يجوز لنا تعديل هذه الشروط من وقت لآخر. ونُخطرك بالتعديلات الجوهرية عبر التطبيق أو الرسائل النصية قبل خمسة عشر يوماً من سريانها.

16.2 استمرارك في استخدام التطبيق بعد سريان التعديل يُعدّ قبولاً به. وإذا لم توافق، يمكنك التوقف عن الاستخدام وإغلاق حسابك.

17. تعليق الحساب وإنهاؤه

17.1 يحق لنا تعليق أو إنهاء حسابك، مع إشعارك متى أمكن، في حال مخالفتك لهذه الشروط، أو الاشتباه في نشاط احتيالي، أو تكرار عدم الحضور، أو إذا اقتضى القانون ذلك.

17.2 يمكنك إغلاق حسابك في أي وقت عبر التطبيق أو بالتواصل معنا، مع مراعاة أن بعض البيانات قد يلزم الاحتفاظ بها للمدد التي يفرضها القانون وفق سياسة الخصوصية.

18. القوة القاهرة

لا نتحمّل المسؤولية عن أي إخلال ناتج عن ظرف خارج عن سيطرتنا المعقولة، بما في ذلك انقطاع شبكات الاتصالات أو الكهرباء، أو الأوبئة، أو الكوارث الطبيعية، أو القرارات الحكومية.

19. أحكام عامة

19.1 القانون الحاكم: تخضع هذه الشروط لقوانين دولة قطر.

19.2 تسوية النزاعات: يسعى الطرفان لتسوية أي نزاع ودياً خلال ثلاثين يوماً. وفي حال التعذّر، تختص محاكم دولة قطر حصرياً.

19.3 قابلية الفصل: إذا تقرر بطلان أي بند، تبقى بقية البنود سارية ونافذة.

19.4 عدم التنازل: عدم ممارستنا لأي حق لا يُعدّ تنازلاً عنه.

19.5 كامل الاتفاقية: تُشكّل هذه الشروط وسياسة الخصوصية كامل الاتفاقية بيننا بشأن استخدام التطبيق.

19.6 لغة الاتفاقية: في حال وجود نسخة بلغة أخرى، تسود النسخة العربية عند الاختلاف.

19.7 التنازل: يجوز لنا نقل حقوقنا والتزاماتنا بموجب هذه الشروط إلى الغير في إطار اندماج أو استحواذ أو إعادة هيكلة أو نقل للنشاط، دون انتقاص من حقوقك. ولا يجوز لك التنازل عن حقوقك أو التزاماتك بموجبها دون موافقتنا الكتابية.

1. Introduction and Acceptance

1.1 These Terms form a binding agreement between you and Mawaeidk for Services W.L.L., commercial registration No. 228056, incorporated in the State of Qatar ("Mawaeidk", "we", "us").

1.2 By using the App, creating an account, or completing a booking, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must stop using the App.

1.3 These Terms are to be read together with the Privacy Policy published in the App, which forms an integral part of this agreement.

2. Definitions

• "App": the Mawaeidk mobile application, its website, and any related interface.
• "User" or "you": any person who creates an account or uses the App.
• "Beneficiary": the person for whom an appointment is booked, whether the User or another person booked on their behalf.
• "Clinic": a healthcare provider licensed in the State of Qatar and listed on the App, including private clinics, medical centres, and hospitals.
• "Booking": a request for an appointment with a Clinic made through the App.
• "Service": the medical or health service provided by the Clinic.
• "Initial Guidance Feature": the optional feature described in Section 7.

3. Nature of the Service and Medical Disclaimer

This section is fundamental. Please read it carefully.

3.1 Mawaeidk is a technology platform for booking and coordination only. We are not a healthcare provider, clinic, hospital, pharmacy, or insurance company.

3.2 We do not provide, directly or indirectly, any medical consultation, diagnosis, treatment, medical opinion, or recommendation of any treatment or specific physician. All content in the App is for organisational and booking purposes only and must not be relied upon as a substitute for professional medical advice.

3.3 The medical and contractual relationship for the provision of the Service arises exclusively between you and the Clinic. The Clinic bears sole and full responsibility for: the accuracy of diagnosis, treatment, and outcomes; the competence and valid licensing of its medical staff; the quality and safety of the Service and compliance with standards of care; the accuracy of advertised prices; and compliance with the laws and regulations of the Ministry of Public Health in the State of Qatar.

3.4 We do not independently verify the professional competence of physicians or the accuracy of information provided by Clinics, and we accept no liability for any harm, medical error, complication, malpractice, or treatment outcome.

3.5 The listing of any Clinic or physician on the App does not constitute a recommendation, endorsement, or guarantee of service quality. The order in which results appear may depend on operational criteria such as distance or availability and does not reflect any medical assessment.

3.6 In an emergency, do not use the App. Call 999 or go immediately to the nearest emergency department.

4. Eligibility and Account

4.1 You must be at least eighteen years old to create an account. You may book an appointment for a minor or a person under your care provided you are their legal guardian, custodian, or authorised representative, and you bear full responsibility for the accuracy and lawfulness of the data provided on their behalf.

4.2 Accounts are verified by a code sent to the registered phone number. You are responsible for maintaining the confidentiality of access to your number and account, and for all activity carried out through it.

4.3 You undertake to provide accurate, complete, and up-to-date information. We may suspend or cancel any account containing false or misleading information.

4.4 You may not create multiple accounts to abuse the service, nor use another person's account without authorisation.

4.5 You may request deletion of your account at any time through the App or by contacting us, as set out in the Privacy Policy.

5. Bookings

5.1 When you complete a Booking, the App sends your request to the Clinic. An appointment is confirmed only upon express confirmation through the App or by the Clinic.

5.2 Displayed appointment slots rely on data provided by the Clinic. We do not guarantee their accuracy or real-time availability.

5.3 If you book for another Beneficiary, you confirm that you are authorised to do so and to share the data necessary to fulfil the appointment, and you bear full responsibility for the validity of that authorisation.

5.4 The Clinic may cancel or modify an appointment for operational or emergency reasons. We will endeavour to notify you as soon as possible, but we accept no liability for any cancellation or postponement by the Clinic, nor for any resulting costs or losses.

5.5 Actual waiting times inside the Clinic are entirely outside our control.

5.6 The App may offer a waiting list when appointments are full. Joining it does not guarantee an appointment, and any resulting appointment remains subject to this Section.

6. Prices and Payment

6.1 Payment is made directly at the Clinic in accordance with its published prices and policies.

6.2 Mawaeidk is not a party to the financial transaction between you and the Clinic, receives no amounts in respect of it, and bears no responsibility for it.

6.3 Any prices displayed in the App are indicative, provided by the Clinic, and may vary according to your condition or additional examinations or procedures. The final price is determined by the Clinic.

6.4 Refund requests, where applicable, are governed by the Clinic's policy and the laws of the State of Qatar. Mawaeidk does not intervene in them.

6.5 Mawaeidk does not collect or store any bank card details. We may in the future offer additional payment options through providers licensed by the Qatar Central Bank. If introduced, these Terms will be updated and the applicable provisions disclosed before activation.

7. Initial Guidance Feature

7.1 The App may offer an optional feature that helps you identify the most suitable medical specialty for your need: you write a brief description, and the App suggests specialties and available physicians.

7.2 This feature is a guidance tool only. It is not medical advice, not a diagnosis, and not a substitute for the opinion of a qualified physician. Suggestions are based solely on your description, may be inaccurate or incomplete, and the final decision on specialty and physician rests with you and the treating physician.

7.3 Do not use this feature in an emergency. Call 999 or go immediately to the nearest emergency department.

7.4 Use of the feature is entirely optional and requires your explicit consent before first use. Not using it does not affect your ability to book or use any other feature of the App.

7.5 The text you write is processed transiently and is not stored, and is not accompanied by your name, phone number, or any personal identifier, as detailed in the Privacy Policy. Please do not include names, ID numbers, or any identifying details about yourself or others.

7.6 We may modify, suspend, or discontinue this feature at any time without this constituting a breach of these Terms.

8. Ratings and User Content

8.1 The App may allow you to rate Clinics and physicians and post comments after a completed appointment. Ratings must reflect a genuine personal experience.

8.2 In any content you post, you must not include: health details about yourself or others; personal data of any third party; or content that is offensive, defamatory, false, or contrary to public order, morals, or the laws of the State of Qatar.

8.3 By posting content, you grant us a non-exclusive licence to display it within the App and in our informational and promotional materials, for the purposes of operating and promoting the service.

8.4 We may review, hide, or remove any content without notice if it breaches these Terms, without incurring any liability.

9. Cancellation and No-Show

9.1 You may cancel or modify an appointment through the App up to one hour before the scheduled time.

9.2 After this window, cancellation is made directly with the Clinic, and any late-cancellation or no-show fees, where applicable, are governed by the Clinic's policy.

9.3 Repeated failure to attend may result in restrictions on your ability to book through the App.

10. User Obligations

You undertake to: provide accurate information, particularly regarding the Beneficiary; not use the App for any unlawful purpose or in breach of the laws of the State of Qatar; not attempt to breach the App or its systems or gain unauthorised access to other users' data; not use automated tools to extract data or create fictitious bookings; and not misuse the Initial Guidance Feature or any other feature contrary to its intended purpose.

11. Data and Privacy

11.1 We collect and process your personal data in accordance with the Privacy Policy published in the App, which forms part of these Terms.

11.2 You acknowledge that completing a Booking requires sharing the necessary data with the relevant Clinic to perform the Service, and you expressly consent to this.

11.3 The processing of your data is governed by Law No. 13 of 2016 on the Protection of Personal Data Privacy and its implementing regulations in the State of Qatar.

12. Intellectual Property

12.1 The App, the name "Mawaeidk", its logo, designs, content, and software are owned by or licensed to us and are protected under applicable laws.

12.2 You are granted a limited, personal, non-exclusive, non-transferable licence to use the App for its intended purposes only. No part of it may be copied, modified, distributed, or reverse-engineered.

13. Changes to the Service

13.1 We may at any time modify the App or add, suspend, or discontinue features, in whole or in part, for operational, technical, or regulatory reasons.

13.2 If the service is permanently discontinued, we will give you reasonable notice where possible, and the Privacy Policy will govern the handling of your data.

14. Limitation of Liability

14.1 The App is provided "as is" and "as available", without any express or implied warranty of continuity, freedom from errors, or uninterrupted operation.

14.2 We are not liable for: any harm arising from the medical Service, its quality, or its outcomes; any decision you make in reliance on suggestions of the Initial Guidance Feature; any cancellation, delay, or change by the Clinic; service interruptions, technical failures, or telecommunications outages; or indirect or consequential damages, loss of profit, or loss of opportunity.

14.3 Subject to the mandatory provisions of Qatari law, our aggregate liability to you for any claim or series of claims, on any basis, shall not exceed one thousand Qatari Riyals.

14.4 Nothing in these Terms excludes or limits any liability that may not be excluded or limited by law.

15. Indemnity

You agree to indemnify us against reasonable losses, claims, and costs, including legal fees, arising from your material breach of these Terms, misuse of the App, or infringement of any third party's rights, to the extent permitted by law.

16. Amendments to the Terms

16.1 We may amend these Terms from time to time. We will notify you of material amendments through the App or by SMS fifteen days before they take effect.

16.2 Your continued use of the App after an amendment takes effect constitutes acceptance. If you do not agree, you may stop using the App and close your account.

17. Suspension and Termination

17.1 We may suspend or terminate your account, with notice where possible, if you breach these Terms, if fraudulent activity is suspected, upon repeated no-shows, or where required by law.

17.2 You may close your account at any time through the App or by contacting us, noting that certain data may need to be retained for the periods required by law, as set out in the Privacy Policy.

18. Force Majeure

We are not liable for any failure resulting from circumstances beyond our reasonable control, including telecommunications or power outages, epidemics, natural disasters, or governmental decisions.

19. General Provisions

19.1 Governing law: these Terms are governed by the laws of the State of Qatar.

19.2 Dispute resolution: the parties shall seek to resolve any dispute amicably within thirty days, failing which the courts of the State of Qatar shall have exclusive jurisdiction.

19.3 Severability: if any provision is held invalid, the remaining provisions remain in full force and effect.

19.4 No waiver: our failure to exercise any right does not constitute a waiver of it.

19.5 Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between us regarding the use of the App.

19.6 Language: in the event of any inconsistency between language versions, the Arabic version prevails.

19.7 Assignment: we may transfer our rights and obligations under these Terms in the context of a merger, acquisition, restructuring, or transfer of the business, without diminishing your rights. You may not assign your rights or obligations under them without our written consent.
